For paid Services, Metaconex or its authorized payment service providers may collect the information necessary to process transactions, including:

Metaconex does not retain complete payment card information where payment processing is performed through payment service providers that comply with applicable security standards.

However, failure to provide information that is necessary for the provision of the Services may prevent users from registering an account, accessing certain features, completing transactions, or receiving the full range of Services and customer support offered by Metaconex.

Users represent and warrant that all information, data, and documents provided to Metaconex are accurate, complete, current, and lawfully obtained. Users are responsible for promptly updating any changes to their information through their account or by contacting Metaconex.

Metaconex shall not be liable for any loss, dispute, claim, or consequence arising from inaccurate, incomplete, outdated, or unauthorized information provided by a user. Users agree to indemnify and hold harmless Metaconex from and against any losses, costs, damages, liabilities, or expenses arising out of or relating to the provision of inaccurate or unlawful information.

  • API Logs;
  • Application Logs;

  • Device Identifiers;
  • Network and connection information;

Such information is used to:

  • Detect and resolve technical issues;
  • Prevent fraud;
  • Investigate violations;
  • Protect the Services;
  • Improve system performance and reliability.

Cookies may be stored as either:

Session Cookies, which are automatically deleted when users close their browser or end their browsing session; or

6.1. Commitment to Data Security

Metaconex is committed to implementing appropriate technical, administrative, and organizational measures to protect personal data and other information processed by Metaconex against unauthorized access, disclosure, loss, alteration, destruction, or misuse.

Data protection measures are implemented based on an assessment of the level of risk, the nature of the data, the purposes of processing, applicable legal requirements, and security standards appropriate to the scale of Metaconex's operations.

While Metaconex makes reasonable efforts to implement appropriate safeguards, users acknowledge and agree that no information system, Internet network, or method of data transmission can be guaranteed to be completely secure. Accordingly, Metaconex cannot guarantee that the Services will be entirely free from security incidents, cyberattacks, or other events beyond its reasonable control.

6.2. Security Measures

To protect data, Metaconex may implement one or more of the following security measures:

  • Encrypting data during transmission and storage where appropriate;
  • Implementing role-based access controls and the principle of least privilege;
  • Applying multi-factor authentication for systems or accounts presenting elevated security risks;
  • Recording and monitoring system logs, access logs, and security events;
  • Deploying firewalls, intrusion detection and prevention systems, distributed denial-of-service (DDoS) protection, and other network security solutions;
  • Managing security patches, software updates, and vulnerability remediation;
  • Performing regular data backups and maintaining disaster recovery plans;
  • Periodically assessing, testing, and improving security controls;
  • Providing employee training on data protection and information security;
  • Implementing other technical and organizational safeguards appropriate from time to time.

The implementation of these measures shall not be construed as a guarantee that all security risks can be entirely eliminated.

6.3. Access to Data

Metaconex restricts access to personal data to personnel, contractors, partners, or service providers who require such access to perform their legitimate duties and who have been granted appropriate authorization.

Individuals and organizations authorized to access data are required to comply with confidentiality obligations under contractual agreements, Metaconex's internal policies, and applicable laws.

Metaconex reserves the right to record and monitor data access activities for auditing, incident investigation, risk management, and the protection of its lawful rights and legitimate interests.

6.4. User Security Responsibilities

Users are responsible for safeguarding their accounts, authentication credentials, and the devices used to access the Services.

Users must not disclose passwords, API Keys, authentication codes, or other security credentials to any individual or organization unless such disclosure is genuinely necessary.

Users must promptly notify Metaconex upon becoming aware of or suspecting any unauthorized access, credential compromise, data breach, or other security incident affecting their accounts.

Metaconex shall not be liable for any loss or damage arising from a user's failure to adequately protect their account or from the voluntary disclosure of authentication credentials to third parties.

6.5. Data Retention

Metaconex retains data for as long as necessary to:

  • Provide and maintain the Services;
  • Perform contractual obligations;
  • Comply with applicable legal requirements;
  • Resolve complaints, disputes, or requests from competent authorities;
  • Prevent fraud and protect system security;
  • Fulfill auditing, accounting, tax, or other legal obligations;
  • Protect the lawful rights and legitimate interests of Metaconex.

The applicable retention period may vary depending on the type of data, the purposes of processing, operational requirements, and applicable legal obligations.

6.6. System Logs and Technical Data

Metaconex may retain system logs, access logs, API logs, authentication logs, transaction logs, IP addresses, device information, and other technical data for a reasonable period in order to:

  • Maintain information security;
  • Investigate and resolve incidents;
  • Prevent fraud;
  • Resolve disputes;
  • Respond to lawful requests from competent authorities;
  • Protect the lawful rights and legitimate interests of Metaconex.

Such information may continue to be retained after a user's account has been terminated or other user data has been deleted where retention is required by applicable law or necessary to protect Metaconex's lawful rights and legitimate interests.

6.7. Data Backup and Recovery

Metaconex may perform periodic backups of data to ensure business continuity and enable recovery in the event of technical failures, system errors, or disasters.

Backup copies may be retained for a specified period in accordance with Metaconex's internal policies. Data contained in backup copies may continue to exist after a user requests deletion until the applicable backup retention cycle expires or the required retention period ends.

The continued existence of data in backup copies does not mean that such data remains available for ordinary operational use.

6.8. Data Deletion

Users may request the deletion of their personal data in accordance with applicable law and the functionalities made available by Metaconex.

Upon receiving a valid request, Metaconex will review and, where appropriate, delete or anonymize the relevant data within a reasonable period, except where:

  • Retention is required or permitted by applicable law;
  • The data is necessary for the performance of contractual obligations;
  • The data is required for resolving disputes, complaints, or investigations;
  • The data is required for auditing, accounting, taxation, or other legal purposes;
  • The data exists in backup copies that have not yet reached their scheduled deletion date;
  • The data has already been anonymized or aggregated and can no longer be used to identify any individual.

Deletion of data may result in users being unable to continue using some or all of the Services.

6.9. Data Recovery

Where users request the restoration of deleted data, Metaconex does not guarantee that such data can be recovered unless otherwise provided by the applicable Service or an agreement between the parties.

Metaconex reserves the right to deny recovery requests where the data has been permanently deleted, the applicable retention period has expired, or restoration could compromise system security, infringe the rights of third parties, or violate applicable law.

6.10. Security Incidents

Where Metaconex becomes aware of a security incident that is likely to materially affect users' personal data, Metaconex will take appropriate measures to:

  • Verify and assess the scope of the incident;
  • Prevent or mitigate potential harm;
  • Remediate the incident;
  • Notify competent authorities or affected users where required by applicable law;
  • Implement preventive measures to reduce the likelihood of recurrence.

Metaconex shall not be liable for security incidents resulting from the actions or omissions of users, independent third parties, or force majeure events beyond Metaconex's reasonable control.

6.11. Service Termination and Data Processing

When a user terminates the use of the Services or an account is closed, Metaconex may continue to retain certain data for the period necessary to:

  • Comply with applicable legal requirements;
  • Fulfill tax, accounting, or auditing obligations;
  • Resolve disputes;
  • Protect the lawful rights and legitimate interests of Metaconex;

Upon expiration of the applicable retention period, the relevant data will be deleted, anonymized, or securely destroyed in accordance with Metaconex's data management procedures, unless otherwise required by applicable law.

6.12. Limitation of Liability

To the fullest extent permitted by applicable law, Metaconex shall not be liable for any loss, unauthorized access, alteration, or disclosure of data arising from:

  • The acts or omissions of the user;
  • The acts or omissions of third parties beyond Metaconex's reasonable control;
  • Failures of infrastructure providers, telecommunications services, or cloud service providers;
  • Viruses, malware, or cyberattacks not resulting from Metaconex's negligence or misconduct;
  • Force majeure events or other objective circumstances beyond Metaconex's reasonable control.

Users acknowledge and agree that Metaconex's liability relating to data protection shall be subject to the limitations of liability set forth in the Terms of Service and to the maximum extent permitted by applicable law.

CHAPTER VII. USERS' RIGHTS REGARDING PERSONAL DATA

7.1. General Principles

Metaconex respects users' rights concerning their personal data in accordance with applicable laws. Users may exercise their rights relating to personal data to the extent permitted by law and subject to the identity verification procedures implemented by Metaconex to ensure information security.

The exercise of users' rights shall not affect Metaconex's rights and obligations to comply with applicable laws, perform contractual obligations, or protect its lawful rights and legitimate interests or those of third parties.

7.2. Right to Be Informed

Users have the right to be informed about how Metaconex collects, uses, stores, shares, and otherwise processes their personal data, including:

  • The categories of personal data collected;
  • The purposes of processing;
  • The legal bases for processing;
  • The applicable data retention periods;
  • The categories of recipients with whom the data may be shared;
  • The rights available to users under this Privacy Policy and applicable law.

Metaconex fulfills this obligation through this Privacy Policy, the Terms of Service, relevant notices, and other documentation published through the Services.

7.3. Right of Access

Users have the right to request confirmation as to whether Metaconex processes their personal data and, to the extent permitted by applicable law, to access or obtain a copy of the personal data maintained by Metaconex.

Deletion of personal data does not necessarily mean that all backup copies will be deleted immediately. Data may continue to exist in backup systems until the applicable backup retention cycle expires in accordance with Metaconex's internal procedures.

Where permitted by applicable law, users may request that Metaconex temporarily restrict the processing of all or part of their personal data.

While such a request is under review, Metaconex may continue processing the data where necessary to:

  • Comply with legal obligations;
  • Protect the lawful rights and legitimate interests of Metaconex;
  • Protect the rights and interests of users or third parties;
  • Ensure the security, stability, and reliability of the Services.

7.7. Right to Object

7.13. Timeframe for Processing Requests

Metaconex will review and process users' requests within a reasonable period in accordance with applicable law or Metaconex's internal procedures.

Where additional time is reasonably required due to the complexity of a request or the need for further verification, Metaconex may extend the processing period and, where appropriate, notify the user accordingly.

7.14. No Limitation on Metaconex's Rights

The exercise by a user of any right under this Privacy Policy shall not limit or otherwise affect Metaconex's right to retain, process, or use personal data where such processing is necessary to comply with applicable law, perform contractual obligations, resolve disputes, protect intellectual property rights, prevent fraud, maintain system security, or otherwise protect Metaconex's lawful rights and legitimate interests as permitted by applicable law.

CHAPTER VIII. INTERNATIONAL DATA TRANSFERS

Metaconex does not guarantee that users' personal data will always be stored in any particular country. The location where personal data is processed or stored may change from time to time to accommodate operational requirements, technical needs, system scalability, or applicable legal requirements.

Metaconex may engage international service providers to support the operation of the Services, including but not limited to:

  • Cloud infrastructure providers;
  • Data center providers;
  • Content Delivery Network (CDN) providers;
  • Security service providers;
  • Payment service providers;
  • Identity verification providers;
  • Data analytics providers;
  • Artificial intelligence model providers;
  • Other technology partners.

These service providers are authorized to process personal data only to the extent necessary to provide services on behalf of Metaconex and are required to comply with applicable confidentiality obligations under contractual agreements and applicable laws.

8.5. Data Protection Safeguards

When transferring personal data internationally, Metaconex may implement one or more of the following safeguards:

  • Data Processing Agreements (DPAs);
  • Standard Contractual Clauses (SCCs), where appropriate;
  • Encryption during transmission and storage;

These safeguards are intended to reduce risks associated with international data transfers but should not be interpreted as a guarantee that unauthorized access or security incidents can never occur.

To the fullest extent permitted by applicable law, Metaconex shall not be liable for any loss or damage arising from the processing of personal data by independent third parties after such data has been lawfully transferred at the user's request, pursuant to contractual arrangements, or as otherwise permitted or required by applicable law.

Metaconex shall also not be liable for damages arising from:

  • The laws or regulations of the destination country or jurisdiction;
  • Actions taken by governmental authorities in the destination country or jurisdiction;
  • Technical failures or security incidents beyond Metaconex's reasonable control;
  • Acts or omissions of service providers that Metaconex has selected with reasonable care and subjected to appropriate due diligence in accordance with industry practices.

8.10. Changes to Data Processing Locations

Metaconex reserves the right to change the locations where personal data is stored or processed as necessary to support operational requirements, optimize system performance, ensure business continuity, enhance security, or comply with applicable legal requirements.

Any such change shall not affect Metaconex's obligations to protect personal data under this Privacy Policy.

8.11. Compliance with International Standards and Certification Programs

Where appropriate based on the scale of its operations and business requirements, Metaconex may adopt, or require its partners and service providers to comply with, internationally recognized standards, certifications, or data transfer mechanisms, including but not limited to:

  • Failures of telecommunications infrastructure, Internet services, cloud infrastructure, or third-party services;
  • Cyberattacks, malware, computer viruses, or force majeure events; or
  • A user's use of the Services in violation of the Terms of Service, the Content Policy, or Metaconex's instructions.

In all circumstances, Metaconex's liability relating to personal data shall be limited to the maximum extent permitted by applicable law and shall remain subject to the liability limitations set forth in the Terms of Service.

10.11. Entire Agreement
