CONTENT POLICY

CHAPTER I. INTRODUCTION AND SCOPE

1.1. Purpose of this Content Policy

This Content Policy ("Content Policy") establishes the standards, principles, and requirements governing all content created, uploaded, stored, processed, shared, transmitted, or distributed through the products, services, platforms, and systems provided by Metaconex.

This Content Policy is intended to:

  • Promote a safe, transparent, and trustworthy online environment;
  • Protect the lawful rights and interests of users, Metaconex, and third parties;
  • Prevent the use of the Services for unlawful purposes or activities that may negatively impact the community;
  • Ensure the stable, secure, and reliable operation of the Services and underlying systems; and
  • Comply with applicable laws as well as internationally recognized standards relating to digital content, information security, and user protection.

This Content Policy forms an integral part of the Terms of Service and shall be interpreted together with the Privacy Policy and any other policies issued by Metaconex.

1.2. Scope of Application

This Content Policy applies to all individuals, organizations, businesses, partners, developers, advertisers, customers, or any other person or entity that accesses or uses any products, services, or platforms provided by Metaconex.

This Policy applies to all content created, generated, uploaded, stored, processed, transmitted, or otherwise made available through the Services, including but not limited to:

  • User Generated Content (UGC);
  • AI-generated or AI-assisted content;
  • Text, articles, comments, and messages;
  • Images, graphics, icons, and designs;
  • Audio, voice recordings, and sound files;
  • Videos, livestreams, and other multimedia content;
  • Uploaded files, documents, and datasets;
  • Websites, landing pages, blogs, content management systems (CMS), or other user-created webpages;
  • Advertisements, marketing materials, and commercial content;
  • Domain names, subdomains, URLs, and metadata;
  • Source code, APIs, scripts, plugins, and other technical components; and
  • Any other form of content created, processed, transmitted, or distributed through the Services.

This Policy applies regardless of whether the content is public or private, free or paid, created directly by users, or generated through Metaconex's tools, features, or Services.

1.3. Definitions

For purposes of this Content Policy:

"Metaconex" means the company that owns, operates, or is otherwise lawfully authorized to provide the products, services, and platforms governed by this Policy.

"Services" means all products, platforms, websites, applications, APIs, systems, artificial intelligence tools, and other services provided by Metaconex.

"User" means any individual or legal entity that accesses, registers for, uses, or otherwise interacts with the Services.

"Content" means any information or data, in any form or format, that is created, uploaded, stored, processed, shared, transmitted, or otherwise made available through the Services.

"User Generated Content" (UGC) means any content created, uploaded, modified, published, or distributed by users through the Services.

"AI Generated Content" means any content generated, in whole or in part, through artificial intelligence technologies or machine learning models provided by Metaconex or third parties.

Capitalized terms not otherwise defined in this Policy shall have the meanings assigned to them in the Terms of Service or under applicable law.

1.4. Metaconex as a Technology Platform Provider

Metaconex operates solely as a technology platform provider and supplies software, technical infrastructure, digital tools, and technology solutions that enable users to create, manage, store, and distribute content.

Unless expressly agreed otherwise in writing, Metaconex is not:

  • A publisher;
  • A content editor;
  • An agent or broker;
  • An advertiser;
  • A representative of any user;
  • The owner of user-generated content; or
  • The party legally responsible for user-generated content.

The provision of the Services by Metaconex shall not be interpreted as an endorsement, verification, certification, approval, or guarantee regarding the legality, accuracy, completeness, reliability, or quality of any content created or provided by users or third parties.

1.5. Relationship with Other Legal Documents

This Content Policy shall be read and applied together with:

  • the Terms of Service;
  • the Privacy Policy;
  • the Cookie Policy (where applicable);
  • the Advertising Policy, API Policy, and any other specialized policies issued by Metaconex.

If any inconsistency exists between this Content Policy and any service-specific terms governing a particular product or Service, the service-specific terms shall prevail with respect to that product or Service to the extent of the inconsistency.

1.6. User Responsibility for Content

Users are solely and exclusively responsible for all content they create, upload, modify, store, share, publish, or distribute through the Services.

Users represent and warrant that all content they submit:

  • Complies with this Content Policy;
  • Complies with the Terms of Service;
  • Complies with applicable law; and
  • Does not infringe the lawful rights or interests of any third party.

Users assume full responsibility for any consequences, claims, disputes, liabilities, damages, or legal actions arising out of or relating to the content they create, upload, or use.

To the fullest extent permitted by applicable law, Metaconex shall not be liable for any content created by users or third parties, even if such content is stored, transmitted, hosted, or displayed through the Services.

Metaconex's failure to proactively review, detect, remove, or restrict any content shall not be construed as approval, endorsement, verification, or acceptance of such content, nor shall it create any legal responsibility on the part of Metaconex.

1.7. Right to Modify this Policy

Metaconex reserves the right to amend, supplement, or update this Content Policy at any time to reflect changes in applicable law, technological developments, business operations, or the operational needs of the Services.

Any revised version will be published through the Website, applications, or other official communication channels of Metaconex and shall become effective upon publication unless otherwise specified.

By continuing to access or use the Services after an updated version of this Policy becomes effective, users acknowledge that they have read, understood, and agreed to be bound by the most current version of this Content Policy.

CHAPTER II. TYPES OF CONTENT GOVERNED BY THIS POLICY

2.1. General Principles

This Content Policy applies to all types of content created, uploaded, stored, processed, edited, shared, transmitted, displayed, or distributed through the products, services, platforms, and systems provided by Metaconex.

The fact that a particular type of content is not expressly listed in this Policy does not mean that such content falls outside its scope. Metaconex reserves the right to evaluate and apply this Policy to any content if it determines that such content may affect users, the system, the community, or the lawful rights and interests of Metaconex.

Users are responsible for ensuring that all content they create, manage, or use complies with this Content Policy, the Terms of Service, and applicable laws.

2.2. User Generated Content (UGC)

"User Generated Content" ("UGC") means any content directly or indirectly created, uploaded, stored, edited, or published by users through the Services.

Such content includes, without limitation:

  • Text, articles, comments, descriptions, and notes;
  • Images, graphics, icons, and designs;
  • Videos, livestreams, and multimedia content;
  • Audio files, voice recordings, synthesized speech, and podcasts;
  • User profiles;
  • Comments, reviews, and feedback;
  • Documents, forms, and files;
  • Websites, landing pages, blogs, or other user-created web pages;
  • Advertisements, banners, and marketing materials;
  • Data, databases, and information entered into the system by users; and
  • Any other content directly or indirectly created by users.

Users are solely responsible for the legality, accuracy, origin, and lawful rights to use all User Generated Content.

2.3. AI Generated Content

Metaconex may provide tools or features utilizing Artificial Intelligence ("AI") to assist users in creating, editing, analyzing, or optimizing content.

AI Generated Content may include, without limitation:

  • Text;
  • Images;
  • Videos;
  • Audio;
  • Synthetic voice;
  • Source Code;
  • Analytical data;
  • Documents;
  • Graphic designs; and
  • Any other content generated by AI models.

Users acknowledge and agree that AI Generated Content may be inaccurate, incomplete, outdated, misleading, or unsuitable for a particular purpose.

Users are solely responsible for reviewing, verifying, and evaluating all AI Generated Content before using, publishing, or distributing it.

Metaconex makes no representations or warranties regarding the accuracy, completeness, legality, reliability, or fitness for any particular purpose of any AI Generated Content.

2.4. User-Created Websites, Landing Pages, and Services

This Policy applies to all websites, landing pages, online stores, blogs, showcase websites, sales pages, content management systems (CMS), or any other digital products created or operated through the Metaconex platform.

Users are solely responsible for:

  • Content displayed on the website;
  • Business information;
  • Products or services offered;
  • Sales policies;
  • Terms of Use;
  • Privacy Policies;
  • Advertising content;
  • Links to third-party websites or services; and
  • The overall legality of the website.

Metaconex shall not be responsible for any transactions, disputes, liabilities, or legal obligations arising from websites or services created by users.

2.5. Advertising and Commercial Content

This Policy applies to all advertising, promotional, marketing, or commercial content created, stored, or distributed through the Services.

This includes, without limitation:

  • Display banners;
  • Display advertisements;
  • Search advertisements;
  • Social media advertisements;
  • Affiliate content;
  • Sales landing pages;
  • Email marketing;
  • SMS marketing;
  • Push notifications; and
  • Product or service promotional content.

Users are responsible for ensuring that all advertising content complies with applicable laws, is not misleading or deceptive, and does not infringe upon the rights of any third party.

2.6. Technical Content

This Policy also applies to technical content or technical components created or deployed through the Services, including but not limited to:

  • Source Code;
  • Scripts;
  • Plugins;
  • Extensions;
  • API Requests;
  • API Responses;
  • Webhooks;
  • HTML;
  • CSS;
  • JavaScript;
  • JSON;
  • XML;
  • Databases;
  • Configuration files;
  • Metadata;
  • Robots.txt;
  • Sitemaps;
  • Schema Markup;
  • AI Prompts; and
  • Prompt Templates.

The fact that content consists of source code or technical data does not exempt users from their responsibilities under this Policy.

2.7. Uploaded Files and Data

Users may upload or store files and data through the Services.

Such files may include, without limitation:

  • Documents;
  • Images;
  • Videos;
  • Audio files;
  • Compressed files;
  • Design files;
  • Spreadsheets;
  • PDF files;
  • Office documents; and
  • Executable files or other data formats.

Users represent and warrant that they possess all necessary legal rights to upload such files and that the upload does not infringe any intellectual property rights, privacy rights, or other lawful rights of any third party.

Metaconex reserves the right to reject, restrict, scan, quarantine, or remove any files that appear to contain malware, malicious software, prohibited content, or that may threaten the security or integrity of the Services.

2.8. Third-Party Content

The Services may allow users to link to, embed, share, or integrate content from third-party platforms, websites, or services.

Metaconex does not control, verify, or assume responsibility for:

  • Third-party content;
  • The accuracy or legality of such content;
  • Third-party policies;
  • The operation of third-party websites or services; or
  • Any damages arising from users' access to or use of third-party content.

Users assume all risks associated with interacting with third-party content or services.

2.9. Operational Data Generated by the Services

In addition to User Generated Content, Metaconex may generate or process technical data necessary for operating the Services, including:

  • System Logs;
  • Access Logs;
  • API Logs;
  • Security Logs;
  • Analytics data;
  • Usage statistics;
  • Diagnostic data;
  • Error reports;
  • Performance metrics; and
  • System metadata.

Such data shall not be considered User Generated Content. Metaconex may collect, store, process, and use such data in accordance with the Terms of Service and the Privacy Policy for the purposes of operating, securing, maintaining, improving the Services, and protecting the lawful rights and interests of Metaconex.

2.10. Metaconex's Right to Classify Content

Metaconex reserves the right to classify, evaluate, label, restrict, limit, or determine the risk level of any content based on:

  • This Content Policy;
  • The Terms of Service;
  • Applicable laws;
  • Community standards;
  • Information security standards;
  • Automated detection systems;
  • Artificial intelligence technologies;
  • Reviews conducted by Metaconex's moderation team; and
  • Reports submitted by users or third parties.

Content classification is conducted to protect users, maintain system security, and promote a safe and healthy environment for the use of the Services.

The classification—or failure to classify—any content by Metaconex shall not be construed as an endorsement, confirmation of legality, verification of accuracy, or recognition of the value of such content, nor shall it create any legal liability on the part of Metaconex.

CHAPTER III. PROHIBITED CONTENT

3.1. General Principles

To maintain a safe, transparent, and legally compliant online environment, users must not create, upload, store, transmit, share, publish, distribute, or use Metaconex's Services to facilitate any content or activities that violate this Content Policy.

The categories of prohibited content listed below are not exhaustive. Metaconex reserves the right to determine, assess, and take action against any content that it reasonably believes may pose risks to users, the system, the community, or the legitimate rights and interests of Metaconex, even if such content is not expressly listed in this Policy.

Users must not use the Services to circumvent, conceal, disguise, or facilitate the creation, storage, or distribution of prohibited content.

3.2. Pornographic and Sexual Content

Any pornographic, sexually explicit, or sexually arousing content is strictly prohibited.

This includes, without limitation:

  • Nude images or videos;
  • Content depicting sexual acts;
  • Sexually explicit or sexually stimulating content;
  • Adult (18+) content;
  • Adult webcam services;
  • Prostitution or prostitution-related services;
  • Online prostitution;
  • Sexual dating services;
  • Sugar dating;
  • Escort services;
  • Content relating to sexual fetishes or deviant sexual behavior;
  • Sex toys or products intended for sexual stimulation (except where permitted by applicable law and expressly authorized by Metaconex).

Metaconex reserves the right to take action against content that has been blurred, partially obscured, or intentionally disguised to evade moderation systems.

3.3. Child Sexual Exploitation Content

Metaconex maintains a zero-tolerance policy toward any content involving the exploitation, abuse, or sexualization of children.

This includes, without limitation:

  • Child Sexual Abuse Material (CSAM);
  • Sexualized content involving minors;
  • Grooming;
  • Sextortion;
  • Child trafficking;
  • Encouraging or instructing child abuse;
  • Unauthorized distribution of children's images.

Metaconex may immediately suspend accounts, preserve evidence, and cooperate with competent authorities in accordance with applicable law.

3.4. Violent Content

Users must not publish or distribute content that:

  • Promotes or glorifies violence;
  • Depicts murder;
  • Torture;
  • Execution;
  • Beheading;
  • Terrorist violence;
  • Graphic gore or excessive bloodshed;
  • Serious accidents;
  • Dead bodies;
  • Decomposed animal carcasses;
  • Excessively shocking or disturbing content.

Metaconex may permit certain content for educational, journalistic, documentary, or research purposes where consistent with applicable law and the public interest.

3.5. Suicide and Self-Harm

The following content is prohibited:

  • Encouraging suicide;
  • Instructions for committing suicide;
  • Promoting self-harm;
  • Dangerous challenges;
  • Games encouraging self-injury;
  • Glorifying or promoting self-destructive behavior.

Mental health support, crisis prevention, educational, or awareness-related content may be assessed separately based on the circumstances.

3.6. Terrorism and Violent Extremism

The following content is strictly prohibited:

  • Terrorist propaganda;
  • Recruitment of members;
  • Fundraising for terrorist organizations;
  • Glorification or praise of terrorist organizations;
  • Distribution of extremist materials;
  • Instructions for committing terrorist acts;
  • Content inciting war or violent extremism.

3.7. Hate Speech and Harassment

Users must not use the Services to:

  • Incite hatred;
  • Promote racial discrimination;
  • Promote gender discrimination;
  • Promote religious discrimination;
  • Harass others;
  • Engage in cyberbullying;
  • Make threats;
  • Intentionally insult or abuse others;
  • Incite violence against individuals or groups.

Metaconex reserves the right to evaluate content based on its context.

3.8. Illegal Drugs and Controlled Substances

Users must not:

  • Sell illegal drugs;
  • Promote controlled substances;
  • Provide instructions for manufacturing illegal drugs;
  • Provide instructions for using illegal drugs;
  • Promote drug paraphernalia;
  • Promote illegal stimulants or narcotics.

3.9. Tobacco and Nicotine Products

Users must not advertise or facilitate the sale of:

  • Tobacco products;
  • Electronic cigarettes;
  • Vape products;
  • Heated tobacco products;
  • Nicotine pouches;
  • Other nicotine products are restricted under applicable law.

3.10. Alcoholic Beverages

Users must not:

  • Encourage alcohol abuse;
  • Promote excessive alcohol consumption;
  • Encourage underage drinking;
  • Organize dangerous drinking games or challenges.

3.11. Gambling

Users must not use the Services for:

  • Online casinos;
  • Betting;
  • Lottery gambling;
  • Gambling activities;
  • Illegal prize-exchange games;
  • Gambling brokerage services;
  • Gambling affiliate marketing;
  • Promotion of illegal gambling.

3.12. Weapons and Explosives

The following are strictly prohibited:

  • Sale of firearms;
  • Ammunition;
  • Bombs;
  • Explosives;
  • Fireworks intended as explosives;
  • Combat knives;
  • Military weapons;
  • Instructions for manufacturing weapons;
  • Instructions for producing explosives.

3.13. Fraud, Scams, and Impersonation

Users must not engage in:

  • Phishing;
  • Scams;
  • Ponzi schemes;
  • Fake investment schemes;
  • Cryptocurrency fraud;
  • Impersonating individuals;
  • Impersonating businesses;
  • Trademark impersonation;
  • Fake websites;
  • Recruitment scams;
  • Employment scams;
  • Forged invoices;
  • Forged documents;
  • Fake certificates;
  • Fake diplomas or degrees.

3.14. Malware and Cyberattacks

Users must not create or distribute:

  • Malware;
  • Viruses;
  • Trojans;
  • Worms;
  • Spyware;
  • Ransomware;
  • Keyloggers;
  • Botnets;
  • Backdoors;
  • Unauthorized exploitation software.

Users must not provide instructions for:

  • Hacking;
  • Software cracking;
  • Distributed Denial-of-Service (DDoS) attacks;
  • Unauthorized vulnerability exploitation;
  • Data theft;
  • Account theft.

3.15. Privacy-Violating Content

Users must not disclose another person's personal information without authorization, including:

  • Doxxing;
  • National identification cards;
  • Passports;
  • Bank account information;
  • Passwords;
  • API keys;
  • Private keys;
  • Access tokens;
  • Medical records;
  • Biometric data;
  • Any other personally identifiable information without authorization.

3.16. Intellectual Property Infringement

Users must not:

  • Infringe copyrights;
  • Infringe trademarks;
  • Copy protected works without authorization;
  • Distribute cracked software;
  • Share pirated software;
  • Distribute infringing content;
  • Sell counterfeit goods;
  • Sell imitation products;
  • Sell products infringing intellectual property rights.

3.17. Spam and System Manipulation

Users must not engage in:

  • Content spam;
  • Comment spam;
  • Email spam;
  • SEO spam;
  • Backlink spam;
  • Keyword spam;
  • Click fraud;
  • Fake traffic;
  • Fake reviews;
  • Fake likes;
  • Fake followers;
  • Fake engagement;
  • Automated bots intended to manipulate the Services.

3.18. AI-Generated Content Used for Fraud

Users must not use artificial intelligence to create:

  • Fraudulent deepfakes;
  • Fake voices;
  • Fake images;
  • Fake videos;
  • Forged documents;
  • Impersonations of others;
  • Financial fraud;
  • False or misleading information intended to deceive;
  • Content designed to bypass security or moderation systems.

3.19. Illegal Content

Any content that violates the laws of the country where the user accesses the Services or any laws applicable to Metaconex is strictly prohibited.

This includes, without limitation:

  • Money laundering;
  • Human trafficking;
  • Illegal wildlife trafficking;
  • Organ trafficking;
  • Terrorist financing;
  • Tax evasion;
  • Violations of trade sanctions;
  • Export control violations;
  • Any activities prohibited by competent governmental authorities.

3.20. Metaconex's Right to Review and Enforce

Metaconex has the sole discretion to determine whether any content violates this Content Policy, taking into account factors including the nature of the content, its context, potential impact, risk of harm, applicable laws, and the legitimate rights and interests of Metaconex or third parties.

Metaconex may take one or more enforcement actions, including but not limited to refusing publication, limiting visibility, applying warning labels, disabling access, removing content, suspending or terminating accounts, preserving data and evidence, and cooperating with competent governmental authorities where necessary.

The categories of prohibited content described in this Chapter are not exhaustive and do not limit Metaconex's discretion. As new forms of content emerge due to technological developments, evolving business models, or changes in applicable laws, Metaconex reserves the right to implement appropriate measures to protect its systems, user community, and legitimate interests, even where such content has not yet been expressly addressed in this Policy.

CHAPTER IV. AI CONTENT POLICY

4.1. General Principles

Metaconex may provide or integrate Artificial Intelligence (AI) technologies to assist users in creating, editing, analyzing, optimizing, or processing content through Metaconex's products and services.

Users acknowledge and agree that AI is a supporting technology, not a human being, and cannot replace users' own judgment, verification, or decision-making.

Any content generated by AI, whether created wholly or partially by AI, remains the responsibility of the user once the user chooses to use, modify, publish, or distribute such content.

4.2. Scope of Application

This Policy applies to all content generated or assisted by AI through Metaconex's Services, including but not limited to:

  • Text (AI Text);
  • Images (AI Images);
  • Videos;
  • Audio;
  • Synthetic voices;
  • Graphic designs;
  • Source Code;
  • AI-generated websites or landing pages;
  • Prompts and Prompt Templates;
  • Data analysis;
  • Reports;
  • Translations;
  • Marketing content;
  • Advertising content;
  • Any other content generated by AI.

This Policy also applies to content generated using third-party AI models when accessed through the Metaconex platform.

4.3. User Responsibility for AI Content

Users are solely responsible for any AI-generated content they use, modify, store, publish, or share.

Before using AI Content, users are responsible for:

  • Verifying the accuracy of the information;
  • Validating data sources where necessary;
  • Assessing whether the content is appropriate for its intended purpose;
  • Evaluating potential legal compliance risks;
  • Checking for possible intellectual property infringement;
  • Assessing potential privacy impacts on third parties;
  • Verifying compliance with applicable industry-specific requirements before publication.

The fact that content was generated by AI does not reduce or eliminate the user's responsibility for that content.

4.4. Accuracy of AI

Users acknowledge and agree that AI may:

  • Produce inaccurate information;
  • Generate outdated information;
  • Produce fictional or hallucinated content;
  • Generate incomplete responses;
  • Produce inconsistent information;
  • Misinterpret context;
  • Provide inaccurate citations;
  • Generate content that may not comply with applicable laws or professional standards.

Metaconex does not warrant that AI-generated outputs will always be:

  • Accurate;
  • Complete;
  • Lawful;
  • Free from infringement of third-party rights;
  • Suitable for the user's intended purpose.

Users must not rely solely on AI when making decisions that may significantly affect their own rights, obligations, interests, or those of others.

4.5. High-Risk Areas Requiring Independent Verification

Users must not treat AI Content as professional advice or as the sole basis for decision-making in high-risk areas, including but not limited to:

  • Legal advice;
  • Medical diagnosis or treatment;
  • Financial investment;
  • Securities;
  • Tax matters;
  • Accounting;
  • Insurance;
  • Recruitment;
  • Education;
  • Credit decisions;
  • Decisions affecting human rights or the legal rights and interests of individuals or organizations.

Users should consult qualified professionals before relying on AI Content in any of the above fields.

4.6. Prohibited Uses of AI

Users must not use AI or Metaconex's Services to create, modify, or distribute content for the purpose of:

  • Fraud;
  • Phishing;
  • Impersonating individuals or organizations;
  • Creating deceptive deepfakes;
  • Voice impersonation;
  • Image forgery;
  • Video forgery;
  • Disseminating false or misleading information;
  • Creating forged documents;
  • Producing fake diplomas or certificates;
  • Creating forged identification documents;
  • Developing malicious software;
  • Creating malware;
  • Creating computer viruses;
  • Developing cyberattack tools;
  • Generating unlawful content;
  • Creating content intended to bypass security or moderation systems;
  • Creating content that infringes the privacy or intellectual property rights of others.

Metaconex reserves the right to immediately take appropriate enforcement actions if it detects or reasonably believes that AI is being used for any of the prohibited purposes described above.

4.7. Prompts and Prompt Engineering

Users are responsible for all prompts or instructions submitted to AI systems.

Users must not use prompts to:

  • Circumvent system safety measures;
  • Jailbreak AI models;
  • Conduct prompt injection attacks;
  • Exploit AI vulnerabilities;
  • Extract data without authorization;
  • Gain unauthorized access to internal information;
  • Steal AI models;
  • Illegally copy or reproduce AI models;
  • Compromise the stability, security, or integrity of the Services.

Metaconex reserves the right to reject, block, or refuse to process prompts that appear to violate this Policy.

4.8. Metaconex's Rights Regarding AI Content

To protect its systems, users, and legitimate interests, Metaconex reserves the right to:

  • Automatically review AI-generated content;
  • Apply labels or warnings to AI-generated content;
  • Restrict AI content generation;
  • Reject prompts;
  • Suspend or terminate AI content generation;
  • Restrict or suspend user accounts;
  • Retain system logs and evidence for investigation purposes;
  • Cooperate with competent governmental authorities where necessary.

Whether or not Metaconex exercises any of the above rights shall not be interpreted as assuming responsibility for AI Content created or used by users.

4.9. Ownership and Use of AI Content

Unless otherwise provided by law or agreed in writing, the fact that AI assists in generating content does not mean that Metaconex transfers or guarantees any intellectual property rights in such AI Content.

Users are solely responsible for determining whether they possess the lawful rights to use AI Content before using it for commercial purposes or making it publicly available.

Metaconex does not guarantee that AI Content will meet users' expectations, be error-free, operate without interruption, or always be suitable for any particular purpose.

Users agree to assume all risks associated with the use of AI Content and shall indemnify and hold Metaconex harmless against any claims, demands, losses, damages, or liabilities arising from the user's use of AI in violation of this Content Policy, the Terms of Service, or applicable law.

CHAPTER V. POLICY FOR USER-GENERATED WEBSITES, SERVICES, AND CONTENT

5.1. General Principles

Metaconex may provide products, platforms, or tools that enable users to create, manage, host, operate, or publish websites, landing pages, online stores, blogs, content management systems (CMS), applications, online services, or other digital platforms.

Users acknowledge and agree that Metaconex acts solely as a Platform Provider, and is not the owner, editor, publisher, or party responsible for any content, products, services, or business activities operated by users.

The provision of technical infrastructure by Metaconex does not constitute an endorsement, certification, approval, or guarantee of the legality of any website or service created by users.

5.2. User Responsibilities

Users are solely responsible for all websites, applications, or services created and operated through the Metaconex platform, including but not limited to:

  • All displayed content;
  • Images, videos, and documents;
  • Products or services offered;
  • Advertising and marketing content;
  • Sales policies;
  • Terms of Use;
  • Privacy Policies;
  • Return and refund policies;
  • Pricing and product information;
  • Promotional programs;
  • Customer data;
  • Transactions with customers;
  • Compliance with applicable laws in the jurisdictions where the user operates.

Users represent and warrant that all websites or services deployed through Metaconex comply with the Terms of Service, Content Policy, Privacy Policy, and all applicable laws.

5.3. Prohibited Website Content and Activities

Users may not use the Metaconex platform to create or operate any website, landing page, or service that involves:

  • Illegal activities;
  • Fraud or scams;
  • Distribution of malware;
  • Phishing;
  • Trademark or brand impersonation;
  • Sale of counterfeit or intellectual property infringing goods;
  • Promotion of illegal gambling;
  • Sale of illegal drugs;
  • Illegal weapons trafficking;
  • Sale of forged or counterfeit documents;
  • Pornographic content;
  • Child exploitation;
  • Terrorism;
  • Money laundering;
  • Fraudulent investment schemes;
  • Illegal pyramid or multi-level marketing schemes;
  • Spam distribution;
  • Search engine manipulation (SEO Spam);
  • Unauthorized data collection; or
  • Any activity prohibited by this Content Policy or applicable law.

Metaconex reserves the right to refuse to provide Services or take enforcement actions immediately upon detecting any indication of such violations.

5.4. Responsibility for Transactions Between Users and Third Parties

Users are solely responsible for all transactions, agreements, payments, commitments, or relationships established between themselves and customers, partners, or any third party through websites or services operated on the Metaconex platform.

Metaconex is not a party to, does not represent, does not guarantee, and assumes no responsibility for:

  • The sale of goods or services;
  • Contract performance;
  • Product or service quality;
  • Payments;
  • Refunds;
  • Warranties;
  • Customer complaints; or
  • Disputes between parties.

Any disputes arising from such transactions shall be resolved solely by the relevant parties.

  • Tax regulations;

Metaconex has no obligation to verify or monitor the legal compliance of individual websites or services operated by users.

5.6. Domain Names and Branding

Users are solely responsible for the registration, use, and management of:

  • Domain names;
  • Subdomains;
  • Logos;
  • Trade names;
  • Trademarks;
  • Brand identity designs; and
  • Other branding elements.

Users represent and warrant that their use of such assets does not infringe the intellectual property rights or other legal rights of any third party.

Metaconex shall not be liable for any disputes relating to domain names, trademarks, or branding.

5.7. Third-Party Content

User-operated websites or services may contain links to, embed, or integrate third-party content, tools, or services.

Metaconex does not control, verify, or assume responsibility for:

  • Third-party content;
  • Third-party websites;
  • Third-party services;
  • Third-party policies;
  • Third-party conduct; or
  • Any damages arising from users' access to or use of third-party services.

Users assume all risks associated with integrating or using third-party services.

5.8. Metaconex's Rights to Review and Enforce

To protect its platform, users, and legitimate interests, Metaconex has the right, but not the obligation, to:

  • Review user websites or services;
  • Analyze content using automated systems or artificial intelligence;
  • Apply warning labels;
  • Restrict accessibility;
  • Suspend Services;
  • Remove all or part of any content;
  • Disable websites;
  • Suspend or terminate user accounts; and
  • Preserve data and evidence for investigations or in response to requests from competent authorities.

Whether or not Metaconex exercises any of the above rights shall not be interpreted as creating any responsibility or liability for user content or activities.

5.9. Disclaimer Regarding User Websites

To the fullest extent permitted by applicable law, Metaconex shall not be liable for:

  • Content published on user-created websites or applications;
  • The accuracy of information;
  • The quality of products or services;
  • Transactions conducted through user websites;
  • Customer complaints or disputes;
  • Damages arising from the operation of user websites;
  • Website compromises, exploitation, or unauthorized use resulting from the actions or omissions of users or third parties; or
  • Any legal obligations arising from users' business activities.

Users agree to defend, indemnify, and hold harmless Metaconex against any claims, liabilities, damages, losses, or expenses arising out of websites, services, or content created or managed by users.

5.10. Platform Integrity Protection

To maintain the stability, security, and integrity of its systems, Metaconex reserves the right to take appropriate measures against any website, application, or service that appears to:

  • Negatively impact technical infrastructure;
  • Consume excessive system resources;
  • Degrade Service performance;
  • Create information security risks;
  • Be suspected of distributing malware or conducting cyberattacks; or
  • Violate the Content Policy or Terms of Service.

Enforcement measures may include resource limitations, service suspension, system isolation, account suspension, content removal, or any other technical measures that Metaconex reasonably considers necessary to protect its systems and the legitimate rights and interests of itself and other users, without incurring any obligation to compensate affected users.

CHAPTER VI. ADVERTISING AND COMMERCIAL CONTENT POLICY

  • Free from material omissions or misrepresentations;
  • Not using another person's images, information, or assets without authorization;

Users must possess all necessary rights, licenses, permissions, or authorizations before using any images, videos, trademarks, content, or other materials in advertisements.

users are responsible for ensuring that all advertising content complies with applicable licensing requirements, legal conditions, and regulatory obligations.

Metaconex reserves the right to require users to provide licenses, certifications, approvals, or supporting documentation before permitting advertisements to continue being displayed.

6.6. AI-Generated Advertising

Users may utilize Metaconex AI tools to assist in creating advertising content.

However, users remain solely responsible for:

  • The accuracy of the content;
  • Commercial claims;
  • AI-generated images;
  • AI-generated videos;
  • Synthetic voices;
  • Marketing content; and
  • Compliance with applicable laws.

The use of AI to generate advertising content does not relieve users of their legal responsibilities for such advertisements.

6.7. Metaconex's Advertising Review Rights

To protect users and maintain the integrity of the platform, Metaconex reserves the right, but not the obligation, to:

  • Review advertising content;
  • Assess risk levels;
  • Apply warning labels;
  • Require modifications;
  • Reject advertisements;
  • Suspend advertisement distribution;
  • Restrict advertisement visibility;
  • Remove advertisements;
  • Disable advertising campaigns; or
  • Suspend or terminate user accounts.

Metaconex may implement any of the above measures without prior notice where it detects indications of policy violations or receives a lawful request from competent governmental authorities.

6.8. Right to Request Supporting Documentation

Metaconex reserves the right to require users to provide documentation necessary to verify the legality of advertising content, including but not limited to:

  • Business licenses;
  • Advertising permits;
  • Marketing authorizations;
  • Product registration documents;
  • Intellectual property certificates;
  • Letters of authorization;
  • Documentation establishing product origin; and
  • Any other documents required by applicable law or Metaconex's risk management procedures.

If users fail to provide the requested documentation within a reasonable period, or if the documentation is insufficient, Metaconex may refuse or terminate the distribution of the relevant advertisements.

6.9. Responsibility for Commercial Transactions

Metaconex is not the seller, purchaser, agent, distributor, intermediary, or contracting party in any transaction between users and their customers.

Metaconex assumes no responsibility for:

  • Product or service quality;
  • Pricing;
  • Warranty policies;
  • Refund policies;
  • Customer complaints;
  • Contracts between the parties;
  • Delivery of goods;
  • Payment processing; or
  • Commercial disputes.

Users are solely responsible for resolving any disputes arising from their commercial activities.

6.10. Limitation of Liability and Platform Protection

To the fullest extent permitted by applicable law, Metaconex shall not be liable for any damages, losses, liabilities, or legal obligations arising from users' advertising content or commercial activities.

Metaconex reserves the right to suspend, restrict, or terminate the provision of Services to any account, website, advertising campaign, or commercial content where there are reasonable grounds to believe that such content or activities:

  • Violate this Content Policy;
  • Violate the Terms of Service;
  • Violate applicable laws;
  • Infringe the rights or legitimate interests of any third party;
  • Jeopardize the reputation, security, safety, or integrity of the Metaconex platform; or
  • Expose Metaconex to potential legal liability.

Whether or not Metaconex exercises its rights to review, reject, restrict, or remove advertisements shall not be construed as an approval, certification, endorsement, or guarantee of the legality of any advertising content submitted by users.

CHAPTER VII. USER RIGHTS AND RESPONSIBILITIES

7.1. General Principles

When accessing or using any products, services, or platforms provided by Metaconex, users are required to comply with the Terms of Service, the Content Policy, the Privacy Policy, and all applicable laws and regulations.

Users shall use the Services honestly, in good faith, and solely for lawful and intended purposes. Users shall not misuse the Services to engage in any unlawful activities or activities that may cause harm to Metaconex, other users, or any third party.

By registering an account, accessing, or continuing to use the Services, users acknowledge that they have read, understood, and agreed to be bound by all policies issued by Metaconex.

7.2. Responsibility for Content

Users bear full legal responsibility for all content that they:

  • Create;
  • Upload;
  • Modify;
  • Store;
  • Share;
  • Publish;
  • Transmit;
  • Distribute; or
  • Otherwise use through the Services.

This responsibility applies to all forms of content, including but not limited to:

  • Text;
  • Images;
  • Videos;
  • Audio;
  • AI-Generated Content;
  • Websites;
  • Landing Pages;
  • Advertisements;
  • Source Code;
  • APIs;
  • Data;
  • Metadata;
  • Domain Names;
  • AI Prompts; and
  • Any other digital content.

The fact that Metaconex provides tools for creating or hosting content does not create any responsibility or liability on the part of Metaconex for such content.

7.3. User Representations and Warranties

Users represent and warrant that all content they provide is:

  • Lawful;
  • Accurate to the best of their knowledge;
  • Compliant with this Content Policy;
  • Compliant with the Terms of Service;
  • Compliant with applicable laws;
  • Non-infringing of intellectual property rights;
  • Non-invasive of privacy rights;
  • Not harmful to others; and
  • Not detrimental to the security, stability, or integrity of the Metaconex platform.

Users are solely responsible for the authenticity and accuracy of all information they provide.

7.4. Account Responsibilities

Users are responsible for:

  • Maintaining the security of their accounts;
  • Protecting their passwords;
  • Safeguarding API Keys;
  • Protecting Access Tokens;
  • Securing authentication credentials; and
  • Not sharing login credentials with unauthorized persons.

Users are responsible for all activities conducted through their accounts, including where unauthorized use results from the user's negligence or failure to maintain account security.

Users must promptly notify Metaconex upon becoming aware of any unauthorized access to their accounts.

7.5. Responsibilities Regarding AI Content

When using Metaconex AI tools, users are responsible for:

  • Reviewing AI-generated outputs;
  • Verifying the accuracy of information;
  • Evaluating suitability before publication;
  • Refraining from using AI to generate prohibited content; and
  • Not using AI for fraudulent, deceptive, impersonation, or unlawful purposes.

Users acknowledge that AI may generate inaccurate, incomplete, misleading, or erroneous outputs and agree to assume all risks associated with their use of AI-Generated Content.

7.6. Responsibilities for Websites and Services

For all websites, landing pages, applications, or services operated through Metaconex, users are solely responsible for:

  • Displayed content;
  • Products or services offered;
  • Sales policies;
  • Terms of Use;
  • Privacy Policies;
  • Business operations;
  • Tax obligations;
  • Legal obligations;
  • Customer relationships; and
  • Disputes with third parties.

Metaconex is neither the owner nor the operator of user-created websites.

7.7. Prohibited Conduct

In addition to the prohibited activities set forth in this Content Policy, users shall not:

  • Interfere with the operation of the system without authorization;
  • Attempt to bypass security measures;
  • Exploit security vulnerabilities;
  • Overload system resources;
  • Conduct cyberattacks;
  • Collect data unlawfully;
  • Impersonate Metaconex;
  • Impersonate Metaconex personnel;
  • Impersonate other users;
  • Use the Services to distribute spam;
  • Create multiple accounts for fraudulent purposes;
  • Circumvent moderation mechanisms or technical limitations; or
  • Engage in any conduct that may adversely affect the stability, security, reputation, or integrity of Metaconex.

7.8. Duty to Cooperate

Users agree to cooperate with Metaconex in connection with:

  • Account verification;
  • Investigation of policy violations;
  • Complaint handling;
  • Dispute resolution;
  • Compliance with requests from competent governmental authorities; and
  • Implementation of security measures.

Metaconex reserves the right to request any information, documentation, or evidence reasonably necessary for the foregoing purposes.

7.9. Indemnification

To the fullest extent permitted by applicable law, users agree to defend, indemnify, and hold harmless Metaconex, its parent companies, affiliates, shareholders, directors, officers, employees, representatives, partners, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or relating to:

  • Violations of the Terms of Service, Content Policy, or Privacy Policy by the user;
  • User-generated or user-utilized content;
  • Websites or services operated by the user;
  • The user's business activities;
  • Violations of applicable law;
  • Intellectual property infringement;
  • Privacy violations; or
  • Any claims, demands, lawsuits, or disputes initiated by third parties.

Indemnifiable losses may include, without limitation, attorneys' fees, court costs, litigation expenses, investigation costs, remediation expenses, settlement amounts, judgments, and any other damages incurred by Metaconex as a result of the user's conduct.

7.10. Limitations on User Rights

Users shall have no right to require Metaconex to:

  • Pre-screen all content before publication;
  • Guarantee that all content is lawful;
  • Ensure uninterrupted operation of all websites;
  • Guarantee that AI-generated outputs are always accurate; or
  • Assume responsibility on behalf of users for any content or transactions.

Metaconex reserves the right to refuse, restrict, suspend, or terminate the provision of the Services if users violate the Content Policy, the Terms of Service, or applicable law, without incurring any obligation to compensate users.

7.11. Continuing Obligations After Service Termination

The user's obligations relating to:

  • Responsibility for content;
  • Indemnification;
  • Intellectual property rights;
  • Confidentiality;
  • Dispute resolution;
  • Financial obligations; and
  • Compliance with applicable law,

shall survive the suspension, termination, or closure of the user's account, or the user's discontinuation of the Services, to the fullest extent permitted by applicable law.

CHAPTER VIII. METACONEX'S MODERATION AND POLICY ENFORCEMENT RIGHTS

8.1. General Principles

To maintain a safe, stable, transparent, and legally compliant service environment, Metaconex reserves the right to review, assess, monitor, and enforce measures against any content, account, website, application, or activity conducted through the Services.

The exercise of the rights set forth in this Chapter is intended to protect users, the system, partners, third parties, and the legitimate rights and interests of Metaconex. Such actions shall not create any obligation for Metaconex to conduct prior review of all user-generated content, nor shall they impose legal liability on Metaconex for any content created by users.

8.2. Right to Moderate Content

Metaconex has the right, but not the obligation, to review, moderate, examine, or evaluate any content created, uploaded, stored, transmitted, or distributed through the Services.

Moderation may be conducted before, during, or after publication and may apply to all or part of any content.

Metaconex may evaluate content based on:

  • This Content Policy;
  • The Terms of Service;
  • The Privacy Policy;
  • Applicable laws and regulations;
  • Community standards;
  • Information security standards;
  • The level of risk posed to the system;
  • Reports submitted by users or third parties;
  • Metaconex's internal assessment.

To preserve the security and effectiveness of its moderation systems, Metaconex is under no obligation to disclose its moderation methods or evaluation criteria.

8.3. Moderation Methods

Metaconex may use one or more of the following methods to detect and address violating content:

  • Manual moderation;
  • Automated moderation systems;
  • Artificial Intelligence (AI);
  • Abnormal behavior detection tools;
  • Fraud prevention systems;
  • Image, video, and audio recognition technologies;
  • Behavioral analytics technologies;
  • User reports;
  • Partner reports;
  • Reports from competent governmental authorities;
  • Any other technical measures that Metaconex considers appropriate.

Failure by the system to detect, or delayed detection of, violating content shall not be construed as approval, endorsement, or confirmation of the legality of such content.

8.4. Right to Take Enforcement Actions

Where Metaconex detects or reasonably believes that any content, account, or activity violates this Policy, Metaconex may take one or more of the following actions, without limitation:

  • Refuse to process content;
  • Refuse publication;
  • Apply warning labels;
  • Reduce visibility;
  • Limit audience reach;
  • Restrict certain features;
  • Temporarily disable content;
  • Remove content;
  • Disable a website;
  • Suspend the Services;
  • Restrict access rights;
  • Temporarily suspend an account;
  • Permanently terminate an account;
  • Revoke access to specific features;
  • Terminate the provision of the Services;
  • Delete data in accordance with the Terms of Service;
  • Implement any other technical measures necessary to protect the system.

Metaconex may determine the appropriate enforcement measure based on the severity of the violation and is not required to apply measures progressively from the least to the most severe.

8.5. Emergency Measures

Where Metaconex determines that there is a risk affecting:

  • System security;
  • Data security;
  • User interests;
  • The reputation of Metaconex;
  • The legitimate rights and interests of third parties;
  • Compliance with applicable laws;

Metaconex may immediately:

  • Suspend an account;
  • Block access;
  • Remove content;
  • Isolate data;
  • Disconnect services;
  • Implement any other necessary technical measures;

without prior notice.

Following the implementation of emergency measures, Metaconex may conduct a further assessment and determine whether to restore or permanently terminate the affected Services, depending on the circumstances.

8.6. Retention of Data and Evidence

Where Metaconex detects or reasonably suspects a violation, it may retain:

  • Content;
  • System logs;
  • IP addresses;
  • Device information;
  • Account information;
  • Metadata;
  • Access history;
  • Edit history;
  • API logs;
  • Other technical data.

Such data may be retained for purposes including:

  • Internal investigations;
  • Complaint handling;
  • Dispute resolution;
  • Protecting the legitimate rights and interests of Metaconex;
  • Complying with requests from competent governmental authorities;
  • Fulfilling legal obligations.

8.7. Cooperation with Competent Authorities

Metaconex may disclose relevant information, data, or documentation to competent governmental authorities where:

  • Required by a lawful request from a competent authority;
  • Required by applicable law;
  • Necessary to investigate violations;
  • Necessary to protect the legitimate rights and interests of Metaconex or third parties;
  • Necessary to prevent fraud, criminal activities, or cybersecurity threats.

The user acknowledges and agrees that such disclosure shall not constitute a breach of confidentiality obligations under the Privacy Policy or the Terms of Service.

8.8. No Obligation of Prior Moderation

The user understands and agrees that Metaconex is under no obligation to:

  • Review all content before publication;
  • Continuously monitor all user activities;
  • Verify the accuracy of all information;
  • Ensure that all content is lawful or does not infringe the rights of third parties.

Metaconex's failure to detect, remove, or promptly address any content shall not be interpreted as:

  • Approval;
  • Endorsement;
  • Warranty; or
  • Acceptance of responsibility for such content.

8.9. Right to Refuse or Terminate the Services

Metaconex reserves the right to refuse or terminate the provision of the Services to any individual or entity where Metaconex reasonably determines that continued provision of the Services may:

  • Violate applicable laws;
  • Cause harm to Metaconex;
  • Adversely affect other users;
  • Compromise information security;
  • Affect the stability or integrity of the system;
  • Expose Metaconex to legal or financial risks.

Any refusal or termination of the Services shall be carried out at the sole discretion of Metaconex and to the fullest extent permitted by applicable law.

8.10. Limitation of Liability

To the fullest extent permitted by applicable law, Metaconex shall not be liable for any damages, losses, data loss, service interruptions, loss of revenue, or other consequences arising from Metaconex's exercise of the rights described in this Chapter for the purposes of:

  • Protecting users;
  • Protecting the legitimate rights and interests of Metaconex;
  • Ensuring the security, safety, and integrity of the system;
  • Preventing violations of the Content Policy or the Terms of Service.

The user acknowledges and agrees that Metaconex's moderation and enforcement decisions are made based on a reasonable assessment of potential risks and shall not give rise to any obligation for Metaconex to compensate the user, except where otherwise required by applicable law.

CHAPTER IX. REPORTING VIOLATIONS, COMPLAINTS, AND APPEALS

9.1. General Principles

Metaconex encourages users, partners, and third parties to proactively report any content or conduct that appears to violate this Content Policy, the Terms of Service, the Privacy Policy, or applicable laws.

The reporting mechanism is established to protect the user community, maintain a safe online environment, preserve the integrity of the system, and minimize risks arising from the use of the Services.

The receipt of a report does not automatically constitute a determination by Metaconex that a violation has occurred. All reports shall be reviewed, evaluated, and handled in accordance with Metaconex's internal procedures.

Metaconex reserves the right to request verification information from the reporting party to ensure the authenticity and validity of the report.

9.3. Reportable Violations

Users or third parties may submit reports concerning content or activities including, but not limited to:

  • Content that violates this Content Policy;
  • Content that violates applicable laws;
  • Fraudulent or deceptive content;
  • Intellectual property infringement;
  • Privacy violations;
  • Harassment or bullying;
  • Spam;
  • AI-generated content intended for fraudulent purposes;
  • Websites or applications suspected of violating this Policy;
  • Unauthorized or unlawful advertisements;
  • Impersonation accounts;
  • Cyberattacks or attacks against the system;
  • Conduct that threatens the security, safety, or integrity of the Services;
  • Any other conduct that the reporting party reasonably believes violates this Policy or applicable law.

9.4. Report Contents

To facilitate the investigation process, a report should include the following information:

  • Contact information of the reporting party;
  • A description of the reported conduct or content;
  • The relevant URL, account, or other identifying information;
  • The date and time the violation was identified;
  • Supporting documents, screenshots, or other evidence (if available);
  • The basis for believing that the content violates this Policy;
  • Any additional information requested by Metaconex.

Metaconex reserves the right to reject reports that are incomplete, unclear, or unsupported by reasonable grounds.

9.5. Report Handling Process

Upon receiving a report, Metaconex may take one or more of the following actions:

  • Record the report;
  • Verify its validity;
  • Collect relevant information;
  • Review the reported content;
  • Request additional information from the relevant parties;
  • Apply temporary restrictions where considered necessary;
  • Make an enforcement decision in accordance with this Policy.

The time required to process a report may vary depending on the nature and complexity of the matter and the availability of information from the relevant parties.

Unless otherwise required by applicable law, Metaconex does not guarantee that reports will be processed within any specific timeframe.

9.6. Right to Appeal

If a user believes that their account, content, or Services have been incorrectly restricted or subject to enforcement action, the user may submit an appeal to Metaconex.

An appeal should include:

  • Account information;
  • The affected content or Services;
  • The decision being challenged;
  • The grounds for the appeal;
  • Supporting documents or evidence;
  • Any additional information requested by Metaconex.

Metaconex may review its previous decision but shall have no obligation to modify or reverse that decision unless sufficient grounds are established.

9.7. Intellectual Property Infringement Reports

An intellectual property rights holder, or its duly authorized representative, may request the removal of content that allegedly infringes its lawful rights.

Such request should include:

  • Information identifying the rights holder;
  • Evidence demonstrating ownership of the relevant intellectual property rights;
  • Identification of the allegedly infringing content;
  • The relevant URL or location of the content;
  • A statement affirming the accuracy and good faith of the request;
  • An acknowledgment of legal responsibility for the submitted report.

Metaconex reserves the right to request additional verification documents before making any enforcement decision.

9.8. False Reports and Abuse of the Reporting System

Users shall not misuse the reporting mechanism to:

  • Harass other persons;
  • Disrupt the operation of the system;
  • Engage in unfair competition;
  • Submit false or misleading information;
  • Make reports in bad faith or for malicious purposes.

Where Metaconex determines that the reporting mechanism has been abused, it may:

  • Reject the report;
  • Issue a warning;
  • Restrict reporting privileges;
  • Suspend or terminate the user's account;
  • Take any other measures permitted under the Terms of Service.

The reporting party shall remain legally responsible for all information submitted.

9.9. Metaconex's Final Decision

To the fullest extent permitted by applicable law, Metaconex shall have sole discretion regarding:

  • Whether to accept or reject a report;
  • Whether to request additional information;
  • The evaluation of reported content;
  • The appropriate enforcement measures;
  • Whether to accept or reject an appeal;
  • The timing of any enforcement action.

Metaconex's decisions shall be made based on its internal assessment, applicable laws, this Content Policy, the Terms of Service, and any other relevant considerations.

Metaconex is under no obligation to disclose its internal review procedures, algorithms, moderation criteria, or the detailed reasoning underlying any particular decision where such disclosure could compromise the security, confidentiality, or integrity of the system.

9.10. Limitation of Liability

To the fullest extent permitted by applicable law, Metaconex shall not be liable for any damages or losses arising from:

  • The acceptance or rejection of any report;
  • The processing or non-processing of any report;
  • The acceptance or rejection of any appeal;
  • The temporary or permanent restriction of content, accounts, or Services;
  • The submission of inaccurate, incomplete, or false information by users or third parties.

The review, investigation, or resolution of any report by Metaconex shall not be construed as an assumption of legal responsibility for the reported content, conduct, or disputes between the relevant parties. Any legal responsibility arising from content created, uploaded, or used by a user shall remain with that user or the relevant responsible party in accordance with applicable law and any governing agreements.

CHAPTER X. POLICY ENFORCEMENT, SANCTIONS, AND GENERAL PROVISIONS

10.1. Enforcement Principles

Metaconex reserves the right to enforce this Content Policy in order to protect its users, partners, systems, and the lawful rights and interests of Metaconex, while ensuring that the Services are provided in a secure, stable, and legally compliant manner.

Enforcement of this Policy may be based on, including but not limited to:

  • Automated moderation systems;
  • Artificial Intelligence (AI) technologies;
  • Internal reviews;
  • Reports submitted by users;
  • Reports submitted by partners;
  • Requests from competent governmental authorities; or
  • Any other lawful source of information.

Metaconex may take enforcement actions without awaiting a decision from any governmental authority where Metaconex has reasonable grounds to believe that a violation of this Content Policy, the Terms of Service, or applicable law has occurred.

10.2. Enforcement Measures

Depending on the nature, severity, frequency, and consequences of a violation, Metaconex may implement one or more of the following measures:

  • Issue warnings;
  • Require modification of content;
  • Require removal of content;
  • Refuse publication;
  • Apply warning labels;
  • Restrict content visibility;
  • Limit access to one or more Service features;
  • Suspend the processing of requests;
  • Temporarily suspend user accounts;
  • Permanently terminate user accounts;
  • Suspend or terminate the provision of the Services;
  • Remove content;
  • Delete data in accordance with the Terms of Service;
  • Revoke API access rights;
  • Revoke licenses;
  • Terminate any related agreements or contracts; and
  • Implement any other technical measures necessary to protect the integrity and security of the Services.

The application of any enforcement measure shall not limit Metaconex's right to impose additional or subsequent measures where appropriate.

10.3. Factors Considered in Enforcement

When determining appropriate enforcement actions, Metaconex may consider one or more of the following factors:

  • The severity of the violation;
  • The frequency of violations;
  • Whether the conduct was intentional or unintentional;
  • The consequences resulting from the violation;
  • The potential impact on other users;
  • The potential impact on the Services and systems;
  • The user's compliance history;
  • The user's ability and willingness to remedy the violation;
  • The user's level of cooperation;
  • Applicable legal requirements; and
  • The lawful rights and legitimate interests of Metaconex.

Metaconex is under no obligation to disclose its internal evaluation methods, enforcement criteria, or decision-making processes.

10.4. Repeated or Serious Violations

Metaconex may immediately suspend or terminate the Services without prior notice in cases including, but not limited to:

  • Repeated violations;
  • Evidence of fraudulent activities;
  • Evidence of scams or deceptive conduct;
  • Attempts to attack or compromise the Services;
  • Distribution of malicious software;
  • Unauthorized access to or compromise of data;
  • Large-scale infringement of intellectual property rights;
  • Distribution of content prohibited by law;
  • Conduct causing, or likely to cause, significant harm to Metaconex, its users, or third parties; or
  • Failure to cooperate during investigations or verification procedures.

10.5. User Indemnification

If a user's conduct causes damage to Metaconex or results in liability being imposed upon Metaconex, the user agrees to fully indemnify Metaconex for all resulting losses.

Such indemnification may include, without limitation:

  • Actual damages;
  • Investigation costs;
  • System recovery and remediation costs;
  • Attorneys' fees;
  • Litigation expenses;
  • Court costs;
  • Administrative fines or penalties;
  • Compensation or settlements paid by Metaconex to third parties; and
  • Any other reasonable costs arising from the user's violation.

This provision shall not limit any additional remedies or claims available to Metaconex under applicable law.

10.6. Protection of Metaconex's Rights and Interests

To protect its systems, assets, data, reputation, and lawful interests, Metaconex may implement any technical, administrative, or legal measures deemed necessary, including but not limited to:

  • Refusing or terminating the provision of the Services;
  • Restricting access rights;
  • Revoking licenses;
  • Suspending or deleting user accounts;
  • Blocking IP addresses or devices;
  • Suspending or removing domains, websites, or hosted services under Metaconex's control;
  • Preserving data, system logs, and electronic evidence; and
  • Initiating legal proceedings or referring matters to competent authorities in accordance with applicable law.

These measures may be taken to preserve the confidentiality, availability, and integrity of the Services and to mitigate legal or financial risks to Metaconex.

10.7. No Waiver

Any failure or delay by Metaconex in exercising any right or remedy under this Content Policy shall not constitute a waiver of such right or remedy.

All rights available to Metaconex under this Content Policy, the Terms of Service, or applicable law shall remain fully reserved and may be exercised at any time.

10.8. Amendments to the Content Policy

Metaconex reserves the right to amend, supplement, or update this Content Policy at any time for purposes including, but not limited to:

  • Compliance with applicable laws;
  • Reflecting technological developments;
  • Protecting the Services and systems;
  • Improving the Services;
  • Preventing new forms of abuse; or
  • Any other reasonable business or administrative purpose.

Any updated version shall become effective upon publication on Metaconex's website, applications, or official communication channels, unless otherwise specified.

A user's continued use of the Services following the publication of an updated Policy constitutes the user's acknowledgment and acceptance of the revised Policy.

10.9. Severability

If any provision of this Content Policy is held to be invalid, unlawful, or unenforceable by a competent authority, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by applicable law.

Any invalid or unenforceable provision shall be interpreted or replaced in a manner that most closely reflects its original intent while preserving the overall consistency of this Policy.

10.10. Final Provisions

This Content Policy forms an integral part of the Terms of Service and shall be read together with the Privacy Policy and any other policies issued by Metaconex.

In the event of any inconsistency between this Content Policy and any product-specific or service-specific terms, the specific terms applicable to the relevant product or service shall prevail.

To the fullest extent permitted by applicable law, Metaconex reserves the right to interpret, apply, and enforce this Content Policy in good faith and in a reasonable manner for the purpose of protecting the legality, security, confidentiality, integrity of its systems, and the lawful rights and interests of Metaconex, its users, and other relevant parties.

The rights, remedies, and enforcement mechanisms provided under this Content Policy are cumulative and shall not limit or exclude any other rights or remedies available to Metaconex under any agreement or applicable law.
